Led by Vaca Daffan Law, Conn Law, and the Clarkson Law Firm, Kahn v. Anthropic, PBC is a putative class action complaint brought by named plaintiffs Karl Kahn and Solomon Smith. Originally filed on June 14, 2026 (Kahn) and July 27, 2026 (Smith), the actions were consolidated on September 4th, and are pending in the Northern District of California.

The complaint alleges that Anthropic misled consumers about the usage and value of its “Max 5x” and “Max 20x” subscription plans for individuals paying to use Claude AI.

What the lawsuit alleges

The complaint alleges that Anthropic markets its commercial subscription plans for Claude by making specific promises to consumers. The company advertised that the Max 5x plan provides “5x more usage than Pro” and that the Max 20x plan provides “20x more usage than Pro”. In reality, consumers receive far less than the promised 5x and 20x usage, despite paying premium monthly subscription fees of $100 or $200, respectively.

The complaint alleges violations of California consumer protection laws including: the Consumer Legal Remedies Act, the False Advertising Law, the Unfair Competition Law, negligent misrepresentation, breach of contract, and breach of the implied covenant of good faith and fair dealing.

The case is a putative class action that seeks relief not just on behalf of the named plaintiffs but also on behalf of similarly situated consumers. The class has not yet been certified by the Court.
